NEW PRC JUDICIAL INTERPRETATION ON PATENT INFRINGEMENT ENTERING INTO EFFECT ON JANUARY 1, 2010

On December 21, 2009, Chinese Supreme People's Court adopted several provisions on Issues Concerning Applicable Laws to the Trial of Patent Infringement Controversies (hereinafter called “Judicial Interpretation”). The Judicial Interpretation draws from the implementation of the Third Amendment to the Patent Law of 2009, and has entered into effect on January 1, 2010.The Judicial Interpretation provides a general guideline that gives PRC courts more discretion on a variety of complex issues. A significant portion of the Judicial Interpretation concerns the determination of the scope of patent protection.
